Draft for review. These terms are being finalised before FREQ's public release and may change. The current version will always be on this page.
These terms cover your use of FREQ, a free location-based game, including its online features.
They're written to be read. By installing or playing FREQ you agree to them. If you don't agree,
please don't use the game.
1. Who we are
FREQ is made by SyphonGames, the games brand of SyphonDigital. SyphonDigital is
the trading name of Nathan William Stokes, ABN 39 706 235 960, of Western Australia. "We" and "us"
in these terms mean SyphonDigital. You can reach us at
support@syphondigital.online.
2. Play safely and lawfully
Stay aware of your surroundings, only visit public places, and stop walking before you play.
- You are responsible for where you go and how you get there. FREQ never requires you to go anywhere in particular, and nothing is worth a risk.
- Never play while driving or riding anything, including a bike or scooter. Don't let the game distract a driver.
- Don't trespass. Stations, relays and signals are placed using public map data (OpenStreetMap). A place appearing in FREQ doesn't mean you may enter it, that it is open or that it is safe. Respect private property, fences, signs, closing times and any rules set by the people who manage a place.
- Follow local laws, including road rules and any rules about public spaces, parks and transport.
- Watch out for traffic, weather, terrain and other people. Avoid unfamiliar places at night, and tell someone where you're going if you're heading somewhere new.
- GPS and map data can be wrong. Treat what the map shows as a game, not as directions or safety information.
3. Who can play
- FREQ is for players aged 13 and over. It is not directed at children under 13, and you must not use it if you are under 13.
- If you're under 18, please check with a parent or guardian before playing, and before you join online play.
- Optional ads are only offered to players who choose 18 or older as their age range (see section 7).
4. Your profile and progress
- You can play without an account. Your collection and progress are saved on your phone.
- If you choose Join the network, we create a guest online profile for your device. It has a public alias (nickname), a friend code you can share, and appears on city boards and other leaderboards. No email, phone number or Google sign-in is used.
- Your guest profile lives on your device. If you clear the app's data, uninstall FREQ or lose your phone, you may lose access to your profile and your progress, and we may not be able to restore them. Android's own device backup may help but isn't guaranteed.
- Choose an alias that isn't your real name and isn't offensive, misleading or someone else's. We may remove or reset an alias that breaks these terms.
- You can delete your online profile at any time: see Delete your FREQ account.
5. Fair play
Please play the game as it's meant to be played. You must not:
- cheat, including spoofing or faking your location (GPS spoofing apps, emulators or similar);
- use bots, scripts, macros or any other automation, or modified versions of the app;
- exploit bugs or glitches for an advantage (tell us about them instead);
- harass, threaten, bully or impersonate other players, or use gifts, aliases or reports to do so;
- interfere with the game, its servers or other players' enjoyment of it, or try to access data that isn't yours;
- buy, sell, share or trade accounts, or arrange to meet strangers through the game.
If we reasonably believe someone has broken these rules, we may reset or remove ranked progress,
season results, station holds or leaderboard places gained that way, remove an alias, or suspend
or end their access to online play. Where it's practical we'll explain why. If you think we've got
it wrong, email us and we'll look again.
6. Virtual items
- Freqs, fragments, lures, gear, stamps, badges and every other in-game item are part of the game. They have no cash value, can't be exchanged for money, and can't be sold or transferred outside the game.
- Gifts between friends inside FREQ are part of the game and are allowed.
- You have permission to use these items in FREQ while you play; you don't own them. We may change, rebalance or remove items as the game develops.
- Nothing in FREQ is sold for real money.
7. Optional ads and third-party services
- FREQ is free and may offer optional rewarded ads (Pirate broadcasts): you choose a reward, then choose whether to watch. You never have to watch one to play. They are only offered if you choose 18 or older as your age range, and are provided by Google AdMob under Google's own terms and policies.
- The game uses other services to work: map data from OpenStreetMap served by OpenFreeMap, place photos from Wikipedia, Wikidata, Wikimedia Commons and Mapillary, the Overpass API, and Supabase for online play. Those services are run by others, may be unavailable or inaccurate at times, and have their own terms. Photos are shown with their author and licence.
- How any of this uses data is explained in the privacy policy.
8. The game can change
FREQ is a live game. We may change, add or remove features, events, seasons, stations or items,
pause online play for maintenance, or stop offering the game or its online features. If we plan
to end online play, we'll try to give notice in the app or on this site first. Your on-device
collection stays on your phone.
9. The game is ours
FREQ, its characters, art, code and name belong to us or to the people who license them to us.
Some music, sounds and photos come from others under their own licences, credited in the game.
We give you a personal, non-exclusive permission to install and play FREQ for your own
non-commercial use. You can share screenshots and the "Share this find" pictures. Please
don't copy, resell or redistribute the app or its art.
10. Our responsibility to you
Nothing in these terms removes rights you have under the Australian Consumer Law
or any other law that can't be excluded. Where those laws apply, they apply in full.
As far as the law allows:
- FREQ is provided "as is" and "as available". We don't promise it will always work, be error-free, or that map data, places, photos or GPS positions will be accurate.
- We aren't responsible for injury, loss or damage arising from where you choose to go, how you travel or what you do while playing, including entering places you shouldn't.
- We aren't responsible for lost progress or items (for example after clearing data, a lost phone or a server fault), or for indirect or consequential loss.
- Where our liability can be limited but not excluded, it is limited to supplying the service again or, at our choice, the cost of having it supplied again.
11. Governing law
These terms are governed by the laws of Western Australia, Australia. You and we can bring
disputes before the courts of Western Australia. If you live elsewhere, you may also have rights
under the laws where you live that these terms can't take away.
12. Changes to these terms
We may update these terms as the game changes. The date at the top will change with them, and
we'll tell you in the app about important changes. If you keep playing after an update, the new
terms apply.
